Terms & Conditions
Effective Date: 17 August 2026
Welcome to Kol A Bakkie. These Terms & Conditions ("Terms") govern your access to and use of the Kol A Bakkie website, platform and related services. By accessing our website, requesting a quotation, making a booking, registering as a driver or transporter, or otherwise using our services, you agree to be bound by these Terms.
Please read these Terms carefully before using the Kol A Bakkie platform.
1. About Kol A Bakkie
Kol A Bakkie operates a digital transport marketplace designed to connect customers requiring transportation services with independent drivers, transporters and transport businesses that have suitable vehicles, capacity and availability.
Transport services may include, but are not limited to, local and long-distance transportation, household and small moves, business deliveries, furniture and appliance transportation, general goods transportation and specialised transport services.
Unless expressly stated otherwise, Kol A Bakkie acts as a marketplace and facilitator between customers and independent transport service providers. Drivers and transporters operating through the platform are independent service providers and are not employees of Kol A Bakkie.
2. Eligibility and Use of the Platform
By using the Kol A Bakkie platform, you confirm that you are legally capable of entering into a binding agreement and that all information supplied by you is accurate, complete and current.
You may not use the platform for unlawful, fraudulent, misleading or abusive purposes, or in any manner that may interfere with the operation, security or integrity of the platform.
3. Transport Quotations
Customers may request transport quotations by providing information about the required collection, delivery, goods, vehicle requirements and other relevant transport details.
Quotations are based on the information supplied at the time of the request. A quotation may be amended where the information supplied is incomplete or inaccurate, or where the actual transport requirements differ materially from those originally provided.
Additional charges may apply where circumstances change, including changes to collection or delivery locations, waiting times, additional stops, incorrect load information, additional labour requirements or other services not included in the original quotation.
4. Bookings
A transport request is not considered confirmed merely because a quotation has been requested or provided. A booking is confirmed only once the applicable booking process has been completed and confirmation has been issued through Kol A Bakkie.
Customers are responsible for ensuring that all booking information, including collection and delivery addresses, contact details, dates, times, goods descriptions and vehicle requirements, is accurate before confirming a booking.
5. Customer Responsibilities
Customers must provide accurate and complete information regarding the goods to be transported and any circumstances that may reasonably affect the transport service.
Customers are responsible for ensuring that goods are appropriately prepared, packaged and ready for collection unless packing or related services have specifically been included in the booking.
Customers must disclose any items that are fragile, unusually heavy, oversized, high-value, hazardous, regulated or otherwise require special handling before confirming a booking.
The customer must ensure that reasonable access is available at both the collection and delivery locations and must disclose relevant access restrictions such as stairs, security procedures, height restrictions, loading restrictions or limited vehicle access.
6. Prohibited and Restricted Goods
Users may not use Kol A Bakkie to arrange the transportation of unlawful goods or any goods that may not legally be transported in the manner requested.
Certain goods may require specialised vehicles, licences, permits, insurance or handling procedures. Customers must disclose the nature of such goods before booking transport.
Kol A Bakkie and/or the assigned transporter reserves the right to refuse transportation where goods are believed to be unlawful, unsafe, improperly disclosed or unsuitable for the vehicle or service booked.
7. Drivers and Transporters
Drivers and transporters wishing to join the Kol A Bakkie network may be required to complete a registration and verification process before being approved to provide services through the platform.
Applicants must provide accurate information regarding themselves, their business, vehicles, licences, operating capabilities and any other information requested during the registration or verification process.
Submission of an application does not guarantee acceptance onto the Kol A Bakkie network. Kol A Bakkie reserves the right to approve, decline, suspend or remove a driver or transporter from the platform in accordance with its operational, safety and compliance requirements.
Approved drivers and transporters are responsible for maintaining all licences, permits, vehicle registrations, roadworthiness requirements, insurance and other legal or regulatory requirements applicable to their operations.
8. Independent Transport Providers
Unless expressly agreed otherwise, transporters using the Kol A Bakkie platform operate as independent service providers. Nothing in these Terms creates an employment relationship, partnership, joint venture or agency relationship between Kol A Bakkie and an independent transporter.
Transporters remain responsible for the operation of their vehicles, their personnel and the lawful and safe performance of transportation services assigned to them.
9. Pricing and Payment
Prices displayed or communicated in relation to a booking will be based on the transport requirements provided by the customer and the applicable pricing arrangements at the time of booking.
Any applicable fees, taxes or additional charges will be communicated where required. Customers are responsible for paying all amounts associated with confirmed bookings in accordance with the payment terms provided during the booking process.
Kol A Bakkie reserves the right to correct genuine pricing errors and to adjust charges where the actual service materially differs from the information supplied when the quotation or booking was created.
10. Cancellations and Changes
Customers should notify Kol A Bakkie as soon as possible if a booking needs to be changed or cancelled.
Cancellation or amendment charges may apply depending on the timing of the cancellation, whether a transporter has already been assigned or dispatched, and any costs already incurred in preparing to fulfil the booking.
Any applicable cancellation terms and charges will be subject to applicable South African consumer protection legislation.
11. Collection and Delivery
Collection and delivery times are estimates unless expressly confirmed otherwise. Transport services may be affected by traffic, weather, road closures, vehicle breakdowns, accidents, security incidents, delays at collection or delivery points and other circumstances outside reasonable control.
Kol A Bakkie will endeavour to facilitate reliable transportation but cannot guarantee that estimated collection or delivery times will always be achieved.
12. Goods, Loss and Damage
Customers should inspect goods at collection and delivery where reasonably possible and should report any apparent loss or damage as soon as reasonably possible.
The responsibility for loss of or damage to goods, and the extent of any applicable compensation, may depend on the circumstances of the transport service, the responsible transport provider, applicable insurance arrangements and South African law.
Customers should not assume that goods are automatically insured against all risks merely because transportation has been arranged through the Kol A Bakkie platform. Where insurance or goods-in-transit cover is applicable to a booking, the relevant terms, exclusions and limits may apply.
13. Limitation of Liability
To the extent permitted by applicable law, Kol A Bakkie will not be liable for indirect, incidental, consequential or special losses arising from the use of the platform or transportation services facilitated through it.
Nothing in these Terms is intended to exclude or limit any liability or consumer right that cannot lawfully be excluded or limited under South African law.
14. Platform Availability
We aim to keep the Kol A Bakkie website and platform available and functioning reliably. However, access may occasionally be interrupted due to maintenance, upgrades, technical problems or circumstances beyond our reasonable control.
We do not guarantee that the website or platform will always operate without interruption or error.
15. Privacy and Personal Information
Kol A Bakkie processes personal information in accordance with applicable South African data protection legislation, including the Protection of Personal Information Act, 2013 ("POPIA").
Information about how we collect, use, store and protect personal information is contained in our Privacy Policy.
16. Intellectual Property
Unless otherwise indicated, the Kol A Bakkie name, branding, website content, graphics, platform design and other materials made available through the website are owned by or licensed to Kol A Bakkie.

17. Acceptable Use
Users must not attempt to gain unauthorised access to the platform, interfere with its operation, introduce malicious software, scrape or misuse platform data, impersonate another person or business, submit fraudulent transport requests, or use the platform in a manner that violates applicable law.
18. Suspension or Termination
Kol A Bakkie may restrict, suspend or terminate access to the platform where a user breaches these Terms, engages in fraudulent or unlawful conduct, creates a safety or security risk, repeatedly fails to fulfil confirmed obligations, or otherwise misuses the platform.
19. Third-Party Services
The Kol A Bakkie website or platform may contain links to, integrations with or services provided by third parties. Those third parties may have their own terms, policies and privacy practices. Kol A Bakkie is not responsible for third-party websites or services except to the extent required by applicable law.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, platform, business practices or legal requirements.
The latest version will be published on this page together with the date on which it was last updated. Where appropriate, we may provide additional notice of material changes.
21. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or the use of the Kol A Bakkie platform will be dealt with in accordance with applicable South African law.
22. Consumer Rights
Nothing contained in these Terms is intended to waive, restrict or exclude any rights that a consumer may have under the Consumer Protection Act, 2008 or any other applicable South African legislation where those rights cannot lawfully be waived, restricted or excluded.
